The South African Chamber of Commerce and Industry (SACCI) has welcomed the appointment of the commission of enquiry into state capture as announced by President Jacob Zuma last night, on the eve of Cyril Ramaphosa’s first NEC sitting as ANC president.

“As this is a matter that has caused concern and an anxiety in the South African body politic, we hope that the commission will get on with its work unhindered and ventilate all issues and allegations of state capture that have occupied the minds of South Africans including through the report of the public protector,” SACCI said.

In yesterday’s statement, President Zuma set out his plans to establish the commission of inquiry into state capture, which is part of the remedial action contained in former public protector Thuli Madonsela’s State of Capture report.

“I have considered this matter very carefully, including the unprecedented legal implications of the order directing the Chief Justice to select a single judge to head the commission of inquiry. I have expressed my reservations about the legality of this directive, which may be the subject of the appeal,” President Zuma said.

“I would like to emphasise that I have faith in all the judges and their ability to execute their tasks with the requisite levels of fairness, impartiality and independence,” he added.

He stated that he had requested the Chief Justice to provide him with the name of the judge to head the Commission.

“He has selected Deputy Chief Justice Raymond Mnyamezeli Mlungisi Zondo to undertake this task.”

SACCI has urged the commission to be resolute in getting the investigation under way and getting the necessary resources allocated to conduct a speedy and diligent enquiry as a matter of urgency.

“We reiterate and support South Africa’s constitutional democracy with the rule of law at its epicentre and hope that at the end of this investigation, the necessary corrective action and remedies will be clearly defined so that this painful negative experience is not repeated again,” SACCI said.
